Westmorland and Furness Council have taken enforcement action against a nation housing developer for unauthorised works at SaddleBack view housing development in Penrith following concerns raised by residents over the installation of new fencing and changes to ground levels.
New wooden fencing approximately 2meters high was installed along the Boundry between the saddleback view development and neighbouring properties on Penny Hill Park with a second fence installed at the end of the new gardens creating what some local residents have said is a visual 4 meter hight wall at the back of their homes.
One residents said “we have gone from uninterrupted views across of the fells to what feels like a prison wall towering over their homes and garden now.”
The new houses have also had the ground levels raised and a new retaining wall constructed to hold back the raised gardens leading to the enforcement action by Westmorland and Furness Council that resulted in a stop notice served on the developers preventing any further work on part of the development until planning permission was considered.
A spokesperson for Westmorland and Furness Council said: "A temporary stop notice has been served on unauthorised works at plots 225,226 and 229 of this site, relating to the raising of ground levels for the rear gardens, erection of retaining walls and the creation of an embankment to the rear of these plots."
It’s understood new home owners of some of the properties were hoping to move in before Christmas but will now face delays until the situation is resolved in the new year.
A planning application for the new fencing and ground levels along with plans to plant trees between the two fences in an area of land that residents have raised concerns the strip of land hidden by the fencing and trees could become another area of anti social behaviour in the town.
A Persimmon spokesperson said “We continue to work closely with Westmorland and Furness Council to deliver these much-needed new homes for local homebuyers, approved by Councillors. We have submitted a small section 73 planning application with regard to garden fencing and small retaining walls in an isolated area of the development.”
